Let Congress fix problems like Ledbetter Act, not judges

Sen. Jeff SESSIONS: At your hearing, several Senators repeatedly referred to Ledbetter v. Goodyear. The statute stated a 180-day limit [& Ledbetter sued after that time limit, and lost]. Congress enacted the Lilly Ledbetter Fair Pay Act, which remedied this statutory flaw. Is it appropriate for a judge to interpret the statute in a manner that is "more just" but inconsistent with congressional intent?

KAGAN: The role of the Court in all cases of statutory interpretation is to interpret the statute in the manner consistent with congressional intent. I do not think it would be appropriate for me to say whether a particular decision conformed to this principle.

SESSIONS: When is it appropriate for the Court to wait for Congress to remedy statutes?

KAGAN :Considerations of stare decisis have special force in the context of statutory interpretation, since Congress can amend the statute if it desires a contrary result.
